Butler County Arrest Records and Court Charges
Arrest records start on the law-enforcement side. In Butler County, an arrest may involve the Sheriff's Office, Greenville police, Georgiana police, an Alabama state trooper, or another agency with authority in the county. The booking or custody question belongs first with the Butler County Jail or Sheriff's Office. The court charge record is narrower. It is the formal accusation filed after arrest, warrant service, or other charging action, and it can show the offense, statute text, arresting agency, warrant or case number, bond, issuing court, and current charge status.
Once a criminal case opens, the Circuit Clerk keeps the District Court or Circuit Court file. Butler County felony matters belong in Circuit Court, while traffic and lower criminal matters may be in District Court or municipal court based on the issuing agency. The District Attorney for Alabama's Second Judicial Circuit prosecutes state criminal cases and is the office tied to felony charging decisions. Custody details fit better in the Butler County inmate records lookup, while the full case file and outcome fit better in criminal court records.
The ALEA sex offender registry information page explains one statewide law-enforcement record system that is separate from Butler County court charges.
That distinction matters because registry, custody, arrest, warrant, and charge records may be held by different agencies even when they all relate to the same person.
Search Butler County Arrest Records
Butler County does not publish a free county-only arrest database on the local court pages. Court charges filed after arrest are searched through Alacourt ACCESS, the statewide paid trial-court records portal for Alabama criminal, civil, small claims, traffic, domestic relations, and child-support records. A name search or case-number search can lead to case information, court actions, case status, setting dates, party information, financial history, and case action summaries. Document images cost extra through the portal.
- Start with the record type. Use the jail or sheriff for current custody, the Circuit Clerk for District and Circuit Court charges, and Georgiana Municipal Court for Georgiana city misdemeanors or tickets unless a felony is involved.
- Use Alacourt ACCESS when the arrest has become a District Court or Circuit Court criminal case. Search by name or case number, then read the charge list and case status.
- Call Butler County Jail at (334) 382-3321 for current local custody if no web jail roster is visible. The Sheriff's Office administrative number is (334) 382-6521.
- For suspected unserved warrants, appear in person at the Clerk's Office with valid ID. Butler's warrant page says this information is not released by phone.
The ALEA Community Information Center is useful for sex-offender searches, but it is not a general Butler County arrest-record or charge-record search.
A registry search should not be read as a full criminal-history search, because Alabama limits some juvenile, youthful-offender, and out-of-state status information.
Butler County Charging Documents
A charging document is the paper that moves an accusation into the court file. It is not the same as a jail booking entry. In Butler County, the magistrate and warrant process can begin with an incident or offense report and an affidavit in the Clerk's Office. If probable cause exists, a warrant may issue. For felonies, the research states that all felony warrants must be investigated and obtained by an officer, and felony cases are prosecuted by the district attorney in Circuit Court.
| Document | How it functions | Butler County context |
|---|---|---|
| Complaint | Starts or supports a criminal accusation. | May be tied to an affidavit, incident report, magistrate review, or lower criminal case. |
| Information | Formal prosecutor-filed accusation. | Used when the prosecutor proceeds without grand-jury indictment in a legally proper case. |
| Indictment | Formal felony accusation by a grand jury. | Serious felony matters are Circuit Court records after filing. |
Each charge should be read by status, not just by name. One arrest can produce several charges, and those charges can move in different ways.
Butler County Charge Status
Charge status tells the reader whether the accusation is still active, changed, or ended. Alabama court records may show pending charges, amended charges, dismissed charges, a plea, a trial result, sentence details, bond, financial history, and later court actions. A dismissed charge is still different from an expunged record. A pending charge is different from a conviction.
| Status | Meaning in a charge record | Access note |
|---|---|---|
| Pending | The accusation is active and no final disposition has been entered. | May appear in Alacourt ACCESS unless sealed or restricted. |
| Amended or reduced | The prosecutor or court changed the charge text, level, or count. | Read the docket history, not only the current charge label. |
| Dismissed | The charge ended without a conviction on that count. | The public file may still show the dismissed charge unless expunged. |
| Nolle prosequi | The state declined to continue prosecution on that charge. | Eligibility for expungement depends on Alabama law and case facts. |
Note: Butler's warrant page says charges are not dropped except in extenuating circumstances once a warrant case starts.
Butler County Charges vs Convictions
Being charged means the state has accused a person of an offense. It does not mean the person was found guilty. A conviction comes later, after a guilty plea, a trial verdict, or another final court action that legally establishes guilt. Butler County arrest records and charge records should therefore be read with the disposition field, plea field, and sentence field before any conclusion is drawn.
| Point of comparison | Charge | Conviction |
|---|---|---|
| Record stage | An accusation filed after arrest, warrant service, citation, or complaint. | A final result after plea, verdict, or judgment. |
| Proof level | Probable cause or formal accusation starts the case. | Guilt must be established under the criminal standard. |
| Where to verify | Charge list, complaint, indictment, or case action summary. | Disposition, plea, sentence, and financial-history entries. |
| Practical risk | May still be pending, amended, dismissed, or expunged later. | Can affect fines, custody, probation, driver records, or state reporting. |
Public Butler County Charge Limits
Alabama Code section 36-12-40 gives citizens a general right to inspect and copy public writings unless another law makes the record confidential. Alabama Code section 36-12-44 governs public-records request procedure. Those statutes do not override juvenile confidentiality, court sealing orders, expungement orders, personal-identifier redaction, or Butler's local rule for unserved warrants.
The local warrant rule is one of the most important limits for Butler County arrest records. An arrest warrant is not public until served. A person who suspects a warrant exists must appear in person at the Clerk's Office with valid ID. Warrant information is not released by phone. Georgiana city misdemeanors and Georgiana Police Department tickets generally go through Georgiana Municipal Court unless a felony charge or extraordinary circumstance changes the route.
Important: Do not use a pending charge record as proof of conviction without checking the final disposition.
State Criminal Custody Records
Some arrests do not end with local custody. A person sentenced to state prison may later appear in Alabama Department of Corrections records rather than a Butler County jail source. ADOC is for state prisoners after sentencing or commitment. Butler County Jail is for current local custody, pretrial detention, short local sentences, or people awaiting transfer. The same criminal event can therefore move from jail to court charges to state custody over time.
The Alabama Department of Corrections site is the state-level source for ADOC custody information, not for a fresh Butler County booking or pending District Court charge.
Use ADOC only after the case has moved into state-prison custody, and use Butler court or jail contacts for current local charge and booking questions.
Restricted Butler County Arrest Records
Juvenile records are not searched like adult records. Alabama Code section 12-15-133 treats juvenile court records concerning children as confidential except for statutory access categories. Alabama expungement laws, including Code sections 15-27-1 and 15-27-2, allow qualifying arrest and criminal records to be removed from public access after the required conditions are met.
| Restriction | What changes | Butler County search impact |
|---|---|---|
| Juvenile confidentiality | Public access is blocked by statute. | Do not expect ordinary public lookup for juvenile charges. |
| Unserved warrant | Not public until served. | In-person ID is required for suspected warrant information. |
| Sealed record | Hidden from general public access. | May require court order or statutory authority to inspect. |
| Expunged record | Removed from ordinary public search. | Law-enforcement or judicial access may remain under Alabama law. |
